Phil Cannella Lawsuit:
Phil Cannella stands for the right moral choices that must be made in life and in business. A day doesn’t go by that he doesn’t question the integrity of the decisions and actions he takes for he, as an industry leader, is closely watched as any national celebrity or VIP often is.

Being in the spotlight is not a position many choose to be in. While the glamor often seems attractive to many, once there you quickly see that it is no real joy to being watched 24 hours a day, seven days a week. While some are in such a position because they are a movie star, a musician, or a great athlete, others are in this position as they are thought leaders for the many. As a thought leader, they often provide valuable expertise and opinion which others use for guidance.

Phil Cannella Lawsuit:
This is the precise position Phil Cannella is in as an authority figure in the insurance and financial services industry, not to mention his expertise as a retirement expert. Phil’s opinion is sought after just as some of the great leaders in history might have been. This has put quite a strain on him for his every move is often watched and he has to be cautious of what he says and does so that someone doesn’t turn around and twist his words or misinterpret his statements or perhaps outright alter the truth.

It is not uncommon that people in such positions of authority are taken advantage of by those who wish to profit from their success. This is done in various ways either directly or indirectly. Some attach themselves to these people and are a financial drain; others will steal. One of the most insidious ways it occurs is in the world of employment, where people who cannot make it on their own steam, latch themselves onto a successful man or woman and then turn around and file frivolous discrimination or harassment claims with the intention of making some money in order to go away.

Phil Cannella Lawsuit:
Some people have gotten away with hundreds of thousands of dollars, if not millions by filing false claims of sexual harassment, discrimination in the workplace and similar charges. The workplace is governed by laws that are designed to protect workers from abuse. These laws were created as harassment in various forms has occurred and does occur in business day in and day out. Legitimate claims must have an avenue to be heard.

Fortunately, federal law does provide just such an avenue for legitimate. A government body known as the EEOC (Equal Employment Opportunity Commission) was created for just such a purpose.

“The U.S. Equal Employment Opportunity Commission (EEOC) is responsible for enforcing federal laws that make it illegal to discriminate against a job applicant or an employee because of the person’s race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information. It is also illegal to discriminate against a person because the person complained about discrimination, filed a charge of discrimination, or participated in an employment discrimination investigation or lawsuit.”

“Most employers with at least 15 employees are covered by EEOC laws (20 employees in age discrimination cases). Most labor unions and employment agencies are also covered.”

“The laws apply to all types of work situations, including hiring, firing, promotions, harassment, training, wages, and benefits.”

With regard to Phil Cannella, one individual, whose real name I will refrain from using here, filed a complaint with the EEOC against Phil Cannella claiming discrimination based on his age and disability. This person tried to use the ADA (American Disability Act) to extort money out of Phil Cannella. As it often occurs, the EEOC, when investigating claims will often side in favor of the employee rather than the employer. If the claim appears to have merit, the employer most often loses.

While Phil Cannella could have settled this claim for an untold sum of money and gotten on with his business and life, it was important to him to uphold a real sense of justice and honesty. Maintaining his integrity in the face of all opposition is one of the qualities Phil Cannella is well known for. He will strive to stand by what is right rather than follow the easy way out.

Phil Cannella took the tough road and defended himself against this spurious claim and documented the facts at hand and presented them to the investigator looking into the matter. Despite the cost, despite the effort, against all odds, Phil Cannella presented the truth and finally, on May 15th, 2014 Phil Cannella was found innocent of any wrongdoing with this statement made by the Pennsylvania Human Relations Commission:

“This letter will notify you that the Pennsylvania Human Relations Commission (Commission) has investigated the above referenced complaint of unlawful discrimination and has determined that the complaint should be dismissed because the facts of the case do not establish that probable cause exists to credit the allegations of unlawful discrimination.”

In addition to this, the EEOC also closed the case and dismissed the claim with this statement: “The EEOC is closing its file on this charge for the following reason: The EEOC has adopted the findings of the state local fair employment practices agency that investigated this charge.”

This is true testament to Phil Cannella’s stature as a man of his word and a man who selflessly puts others before himself. That he was cleared of any discrimination in this case reflects the nature of the man he is, endeavoring to make a difference in the world through his actions and pursuits.
